Legislation hearings that were introduced by the leader in the regulation and legalization of Internet poker, U.S. Representative Barney Frank, that look to overturn the provisions of the very unpopular Unlawful Internet Gambling Enforcement Act (UIGEA) have been delayed until September of this year. This according to the Poker Players Alliance (PPA), which is one of groups that has supported Frank in helping create the measures that Frank has introduced to Congress.
The most important legislation sponsored that is affected by the delay in major way is Frank’s bill the Internet Gambling Regulation Consumer Protection and Enforcement Act. This Act wants to come up with a regulatory framework in the federal level of the United States for online gambling operators. To date this bill has been signed onto by 35 co-sponsors in Congress. Frank also introduced a 2nd bill, which is the Reasonable Prudence in Regulation Act looks to put off the implementation of the provisions of the UIGEA that were enacted on January 9th of this year and now these may be moot because of the recent delay in the hearings. A 3rd bill related to online gambling that was written by U.S. Representative James McDermott, which is the Internet Gambling Regulation and Tax Enforcement Act, is a companion bill to Frank’s Internet Gambling Regulation Consumer Protection and Enforcement Act and hearings on that will also be delayed until September.
There have been no details given why the hearings were delayed. The hearings were originally supposed to take place around July 9th or be held when the Poker Player’s Alliance were supposed to be in Washington D.C. as part of their “National Poker Week.” The ongoing economic crisis in the United States, and around the world, has been the main focus of the House Financial Services Committee. Representative Frank is the chairman of this committee and it will be this committee where the bills concerning online gambling will be heard.
There have been many bills introduced to try to repeal the ban on online poker and to regulate the online gambling industry, most of which were introduced by Frank, but not one has been passed. With the new Obama administration many online poker players and the PPA are hopeful that the ban will be repealed soon.

Hotels in Las Vegas are making $5.8 million per day less then only a year ago according to the latest figures from the convention and visitors authority. It seems like there has been a lot in the news recently dealing with online poker and online gambling and the ongoing debate on whether to legalize it or not. First there was the Kentucky domain name case and then the recent decision by the state of Minnesota to not block online gambling sites to their residents. There is also a recent bill by Robert Frank that will be put to a vote in Congress soon. Now the state of Florida may be the first state in America to legalize online poker.
In Florida the main focus has been on the ratification in the state’s legislature of the gambling compact with the Seminole Tribe, as well as the omnibus gambling reform to aid in the state’s struggling pari-mutual industry. Lawmakers in Florida have quietly put a measure into a regulatory bill that is not related that may make Florida the very first state in the U.S. to make online poker legal for citizens of the Sunshine State.
House bill 425, which was recently passed by legislature in Florida by an impressive margin, has in the bill a provision that requires the policy research arm of the state legislature to perform a thorough study on the effects of online poker on the land based poker rooms in Florida. Recently the European Commission (EC) issued a report that had findings that United States law in terms of online gambling are not justified and they laws are discriminatory against foreign online gambling operators. Representative Barney Frank recently introduced legislation, which was the Internet Gambling Regulation, Consumer Protection and Enforcement Act that would deal with this trade dispute. The Act would regulate online gambling and make foreign and domestic online gambling operators be on the same level.
Jeffrey Sandman, who is a spokesperson for the Safe and Secure Internet Gambling Initiative, recently stated, “The European Commission report provides yet another reason why the administration and Congress should support pending legislation to regulate Internet gambling, which would resolve the trade agreement violation and better protect consumers. The Obama Administration should seek to forge a new direction on Internet gambling, rather than keeping in place a protectionist trade policy that hypocritically discriminates against foreign online gambling operators.”
The EC report was brought about by a complaint by a Trade Barrier Regulation and the Remote Gambling Association (RGA) filed the compliant. The RGA concluded that the treatment of foreign online gambling operators by the United States in laws that are in place makes it difficult for European companies to have access to the U.S. market. The report also found that the U.S. is violating international trade law, as they state they are using legal action to go after foreign online gambling operators, as at the same time they allow domestic operators, especially those dealing with horse racing, to thrive in the U.S. market.
The report also suggests that in order to resolve this trade dispute there should be talks with the new Obama Administration. If the EC and the U.S. are not able to negotiate to resolve the issue the EC may go to the World Trade Organization and file a case against the U.S.
The legislation presented by Frank would bring about an online gambling framework dealing the licensing and enforcement, which would let online gambling operators from U.S. residents. Also, Frank’s legislation mandates several protections for consumers, such as underage gambling, problem gambling, fraud, identity theft, and money laundering.
There was a companion piece of legislation to Frank’s bill, which was introduced by Representative Jim McDermott. This piece is the Internet Gambling Regulation and Tax Enforcement Act, which would deal with the taxation and regulation of online gambling. If the U.S. were to tax online gambling the U.S. would pull in an estimated revenue of between $48.6 billion and $62.7 billion over the next 10 years, according to a tax revenue analysis. If this legislation by McDermott is not passed by Congress the revenue will not be collected, as millions of Americans that gamble online will continue to do so without having any consumer protections.

The Minnesota Department of Public Safety Alcohol and Gaming Enforcement Division (AGED) recently made the decision to not block Internet gambling websites from residents from the state of Minnesota. The decision was part of an agreement between the AGED and the Interactive Media Entertainment & Gaming Association (iMEGA) and in return iMEGA dropped their civil suit against the AGED.
iMEGA chairman Joe Brennan Jr. stated, “We’re very happy with the outcome. It was clear the public opposed this, and the swift negotiated settlement by DPS and AGED demonstrates both the merit of our suit and the shaky legal ground that the original ‘black list’ were based.”
In a letter to the ISP’s that took back the block request, director if the AGED John Williams sited the lawsuit of the iMEGA as one of the main reasons that they will not continue to pursue the Minnesota website blocking issue. In the letter Williams wrote, “iMEGA alleged that the notice was not authorized under 18 U.S.C. 1084 and violated the First Amendment and the Commerce Clause. Whether or not iMEGA would have prevailed in court is unknown. Notwithstanding, the AGED has agreed to withdraw the notice. As a result, iMEGA has agreed to dismiss its court action without prejudice. I believe it may be more appropriate to resolve this problem by working to create clear and effective governmental policies concerning regulation of gambling.”
The Poker Players Alliance (PPA), which has more than 15,000 members in the state of Minnesota as well as over a million in America, helped the situation and put political pressure on the AGED. Matthew Werden, who is the PPA Minnesota State Director stated, “Minnesota poker players made our voices heard, the state listened and ended its ill-advised and improper attempt to circumvent the rights of Minnesota poker players.”
When asked about the situation in Minnesota and the seizure of poker player’s funds from online payment processors by the U.S. Department of Justice PPA Executive Director John Pappas stated, “I think it’s been a weird couple of months. It was kind of amateur hour up their (in Minnesota) and they eventually conceded to that point and finally announced they were going to stop enforcement of it. And it sends a strong signal to the state that state-by-state action is the wrong approach and will be defeated on legal grounds and political grounds. My understanding from the politicians is they didn’t realize how many people played poker. I had an opportunity to speak with (Minn. Gov.) Tim Pawlenty and he said ‘this was a boneheaded, politically tone deaf move’ by the people in his agency.”
Minnesota State Representative Pat Garofalo was very happy with the recent AGED decision and he also introduced state legislation to halt the move stated, “This is a great day for internet freedom. In the spirit of cooperation and in recognition of the rescission of these notices, I am more than happy to withdraw my bill and in its place sponsor a discussion aimed at establishing a framework for regulating and licensing the online gaming industry.”
The recent decision may have an impact on the legalization of online gambling in the US, since a state has decided to allow residents to play.

The U.S. Justice Department is starting to lay down the law in terms of the illegal action of online gambling. It has been recently reported that seizure warrants have now been secured and because of that the United States government has frozen online payment processor accounts.
The Poker Players Alliance (PPA), which is a leading lobbyist that makes sure that Internet poker is not a part of laws dealing with online gambling, were not pleased when they had discovered that the U.S. government had frozen the accounts. The accounts are thought to be holding an estimated $30 million in player winnings. The PPA recently sent a letter to the Assistant United States Attorney for the Southern District of New York asking for a chance to be heard in any warrant hearings in the future. The PPA is coming off a court win in the state of Minnesota where a state lawmaker withdrew their bill to halt Internet service providers from blocking gambling websites on the Net. After looking at the facts the Minnesota lawmaker changed his views and made the decision to try to push for legalizing and regulating online gambling.
U.S. Representative Barney Frank has been at the forefront of legalizing Internet gambling and his plan is for regulating online gambling, which would reap billions of dollars for the U.S. government. Two new Bills have been introduced by Frank to Congress. One of the Bills would block the rules for the Unlawful Internet Gambling Enforcement Act (UIGEA) from going into effect. The second Bill would outline who to both regulate and legalize Internet gambling in the United States.
Frank’s first Bill proposed was to halt what the government did recently in the freezing of online accounts for Internet poker players. Frank believes the UIGEA rules have to be clearly defined, which they currently are not, and looked at closely before the government starts to interfere with the online gambling industry.
The PPA recently told the Associated Press that the US Attorney for New York’s Southern District has ordered three banks to freeze accounts. Also, The AP reported that a seizure warrant was issued recently for an account at a Wells Fargo bank in San Francisco.
